Over 200 lawsuits were filed against the Hertz rental car company by former customers who were arrested as a result of the company’s poor inventory control system and its implementation of two business practices which led to the filing of unsubstantiated stolen car reports with police. According to a whistleblower, these practices essentially meant Hertz was using police “as a repo company and the court system as a collection company” (News Nation 2022, 4:24). Consequences to the individuals who were falsely (...) charged with theft included financial hardship, job loss, reputational damage, child custody problems, the trauma of arrest sometimes at gunpoint, and the traumatic experience of being jailed. This case study calls for students to analyze the company’s actions from the perspectives of ethical theories and decision making, as well as corporate social responsibility. (shrink)

A number of articles and empirical studies over the past decade, most by Paul Robinson and co-authors, have suggested a relationship between the extent of the criminal law's reputation for being just in its distribution of criminal liability and punishment in the eyes of the community – its "moral credibility" – and its ability to gain that community's deference and compliance through a variety of mechanisms that enhance its crime-control effectiveness. This has led to proposals to have criminal liability and (...) punishment rules reflect lay intuitions of justice – "empirical desert" – as a means of enhancing the system's moral credibility. In a recent article, Christopher Slobogin and Lauren Brinkley-Rubinstein (SBR) report seven sets of studies that they argue undermine these claims of empirical desert and moral credibility and instead support SBR's proposed distributive principle of "individual prevention," a view that focuses on an offender's future dangerousness rather than on his perceived desert. -/- The idea that there is a relationship between the criminal law's reputation for justness and its crime-control effectiveness did not originate with Robinson and his co-authors. Rather, it has been a common theme among a wide range of punishment theory scholars for many decades. A particularly important conclusion of recent Robinson studies, however, is their confirmation that this relationship is a continuous one: even small nudges in moral credibility can produce corresponding changes in the community's deference to the criminal law. This is important because it shows that even piecemeal changes or changes at the margin – as in reforming even one unjust doctrine or procedure – can have real implications for crime-control. SBR's studies, rather than contradicting the crime-control power of empirical desert, in fact confirm it. Further, SBR's studies do not provide support for their proposed "individual prevention" distributive principle, contrary to what they claim. -/- While SBR try to associate their principle with the popular "limiting retributivism" adopted by the American Law Institute in its 2007 amendment of the Model Penal Code, in fact it is, in many respects, just the reverse of that principle. With limiting retributivism, the Model Code's new provision sets desert as dominant, never allowing punishment to conflict with it. SBR would have "punishment" essentially always set according to future dangerousness; it is to be constrained by desert only when the extent of the resulting injustices or failures of justice is so egregious as to significantly delegitimize the government and its law. This ignores the fact that even minor departures from justice may have an important cumulative effect on the system as a whole. What SBR propose – essentially substituting preventive detention for criminal justice – promotes the worst of the failed policies of the 1960s, where detention decisions were made at the back-end by "experts," and conflicts with the trend of the past several decades of encouraging more community involvement in criminal punishment, not less. The problem of 'no fault' compensation for patients who suffer adverse effects as a result of their participation in clinical trials is discussed in the light of the guidelines issued by the Association of the British Pharmaceutical Industry (ABPI) and our recent experiences in reviewing protocols submitted to the local ethics of surgical research sub-committee. We have found a variety of qualifications being applied by pharmaceutical firms which are not in the spirit of the guidelines, let alone the interests of (...) the patient, and we suggest a means whereby the patients can be assured of fair treatment in the event of 'no fault' injury. I argue that Plato's purpose in the discussion of false belief in the "Theaetetus" is to entertain and then to reject the idea that thinking is a kind of mental grasping. The interpretation allows us to make good sense of Plato's discussion of 'other-judging' (189c-190e), of his remarks about mathematical error (195d-196c), and most importantly, of the initial statement of the puzzle about falsity (188a-c). That puzzle shows that if we insist on conceiving of the relation between thought and its (...) objects on the model of holding or grasping something in our hands, we will be unable to account for the possibility of false identity judgments: For no one who is literally grasping two things in his hands would seriously entertain the idea that one of the things is numerically identical with the other. Leo Szilard conceived of the possibility of nuclear fission sustained by a chain reaction years before it was achieved in the laboratory. He was also one of the initiators of the atomic bomb project in the United States. Yet he (...) dedicated his final years to the causes of understanding and sustaining life. The eminent physicist became a biologist and a vital force calling, for the control of nuclear and other weapons. This book documents Szilard's energetic attempts to influence public policy on arms control and disarmament issues, both through open political processes and statements and through behindthe-scenes contacts with Washington power sources and a remarkable exercise in personal diplomacy with Nikita Khrushchev. Many of the issues Szilard deals with in this valuable record of the years 1947-1963 are still crucial today. His opposition to antiballistic missile systems, his proposal for a Washington-Moscow "hot line," his work on the Pugwash conferences that brought together scientists from the East and the West, his pivotal role in the creation of the Council for a Livable World, his advocacy of a nuclear policy of no-first-use and restricted retaliation, and his support of "minimum deterrence" in place of an overwhelming counterforce capability - all these matters are as important in the 1980s as they were in the 1950s and 1960s. One of the most lasting contributions of Marr's posthumous book is his articulation of the different “levels of analysis” that are needed to understand vision. Although a variety of work has examined how these different levels are related, there is comparatively little examination of the assumptions on which his proposed levels rest, or the plausibility of the approach Marr articulated given those assumptions. Marr placed particular significance on computational level theory, which specifies the “goal” of a computation, its appropriateness for (...) solving a particular problem, and the logic by which it can be carried out. The structure of computational level theory is inherently teleological: What the brain does is described in terms of its purpose. I argue that computational level theory, and the reverse-engineering approach it inspires, requires understanding the historical trajectory that gave rise to functional capacities that can be meaningfully attributed with some sense of purpose or goal, that is, a reconstruction of the fitness function on which natural selection acted in shaping our visual abilities. I argue that this reconstruction is required to distinguish abilities shaped by natural selection—“natural tasks” —from evolutionary “by-products”, rather than merely demonstrating that computational goals can be embedded in a Bayesian model that renders a particular behavior or process rational. Today’s fast-moving, media lifeworld embodies many of the metaphors of its analog predecessors – including those of warfare and conflict. The metaphor of warfare is used to describe everything from corporate marketing strategies to political campaigns, often with harmful consequences. In one way of exploring the front lines of the resulting war on truth, we describe some lessons learned from the experience of military veterans who have actually endured the liminality of combat, and who emerge with what is increasingly termed (...) moral injuries. We use their experience as an analogy for competing narratives in cyberspace, where objective standards of truth and facticity are apparent casualties, and where fake news is emerging as victorious. We then apply models of social construction, specifically the practical theory of the Coordinated Management of Meaning, and the metaphor of jazz improvisation in the context of Schutz’s lifeworld phenomenology as possibly useful, helpful, and hopeful ways of acting into the complexity of truth together. Cimino's The Deer Hunter is a mass culture product that sells. It is a conventional, manipulative Hollywood movie that moves large U.S. audiences. In trying to identify the ideological function of this film, Leibowitz has compared The Deer Hunter to Nazi ideology or German Romantic nationalist aesthetics. This comparison, however, says little about the film itself. To invoke this German tradition is to do little more than to invoke the roots of the modern culture industry in general. The Nazis are (...) only unique in that they succeeded early in blending propaganda, violence, pornography, religion and a consumer mentality in a mechanism of cultural manipulation. (shrink)

Near the end of the Amherst Cofloquium on “Nietzsche Today: The Reception of his Work after 1968,” Geoff Waite challenged the underlying historical assumption: “Is 1968 chosen because it marks the approximate date of the publication of the first volume of the splendid critical edition of Nietzsche's work by Colli and Montinari, or rather the approximate date of the until recently wholly apolitical appropriation of Nietzsche by post-structuralism? Do we wish to allude to die year of the Zagreb meeting on (...) Nietzsche of “creative Marxists” trying, as they said, to locate “the theme of human freedom in Nietzsche,” or rather to the year that Jiirgen Habermas delivered himself of the opinion that “Nietzsche is no longer contagious?” For some of us, however, 1968 has to mean also and mainly May '68.”. I extend Jones & Love's (J&L's) critique of Bayesian models and evaluate the conceptual foundations on which they are built. I argue that: (1) the part of Bayesian models is scientifically trivial; (2) theory is a fiction that arises from an inappropriate programming metaphor; and (3) the real scientific problems lie outside Bayesian theorizing.

La pertinence de la métaphysique analytique a fait l'objet de critiques : Ladyman et Ross, par exemple, ont suggéré d'abandonner ce domaine. French et McKenzie ont défendu la métaphysique analytique en affirmant qu'elle développe des outils qui pourraient s'avérer utiles pour la philosophie de la physique. Dans cet article, nous montrons dans un premier temps que cette défense heuristique de la métaphysique peut être étendue au domaine scientifique de l'ontologie appliquée, qui utilise des théories et outils issus de la métaphysique (...) analytique. Dans un deuxième temps, nous développons le parallèle que font French et McKenzie entre les mathématiques et la métaphysique pour montrer que l'ensemble du domaine de la métaphysique analytique, étant donné son utilité non seulement pour la philosophie mais également pour la science, devrait continuer à exister en tant que domaine largement autonome. In 2013, Bennett proposed a mereological theory in which the parthood relation is defined on the basis of two primitive relations: a is a part of b iff a fills a slot owned by b. However, this theory has issues counting how many parts an entity has. We explore the various counting problems and propose a new theory to solve them. Keeping the core idea of Bennett’s slots, this theory introduces mereological relations between slots. This theory enables us to solve (...) all known counting problems and to go beyond the limits of Bennett’s theory by theorising expected features of mereological theories: supplementation principles and mereological sum and fusion. The theory is illustrated on ontological issues on the nature of structural universals and informational entities. (shrink)

This essay explores the contemporary experiences of women who live with pain, given the complex responses they encounter within Western medical systems, including pervasive stigma, bias, clinician disbelief, and poor health outcomes. In response to these realities, as highlighted within recent literature and exemplified in a first-person account provided by the paper’s author, this essay explores the Christian practice of the Stations of the Cross as a faithful response to women living with pain. The Stations provide a distinctive Christian practice (...) that invites women living with pain, as well as their clinicians and loved ones, into faithful care marked by prayer, solidarity, and hospitable listening. Practicing the Stations provides one faithful response that Christian clinicians and those who live with pain might engage in the clinic and beyond. (shrink)

The performance appraisal process is increasingly seen as a key link between employee behaviour and an organization’s strategic objectives. Unfortunately, performance reviews often fail to change how people work, and dissatisfaction with the appraisal process has been associated with general job dissatisfaction, lower organizational commitment, and increased intentions to quit. Recent research has identified a number of factors related to reactions to performance appraisals in general and appraisal satisfaction in particular. Beyond the appraisal outcome itself, researchers have found that appraisal (...) reactions are affected by perceptions of fairness and the relationship between the supervisor and the employee. To explain the relationships among these factors, the present article proposes a moral cognition perspective. We suggest that employees judge a performance appraisal from the perspective of its moral justifiability, and that appraisal reactions will be determined, at least in part, by the perceived moral justifiability of the process. The proposal was supported by results from a survey of government employees using measures of performance ratings, leader–member exchange, perceived utility, and organizational justice. (shrink)

D. Barton Johnson traces the parallel lives and literary origins of two Russo-American writers: Ayn Rand and Vladimir Nabokov. Born in Saint Peterburg six years apart, they overlapped on the New York Times bestsellers list in the late fifties. While Nabokov's Russian cultural roots have been much explored, Rand's were little realized prior to Chris Matthew Sciabarra's investigation of her Russian philosophical context. Nabokov and Rand represent polar examples of their cultural heritage: for Nabokov, the aesthetically-oriented tradition of the (...) modernist Russian Symbolists; for Rand, the social-utilitarian tradition of Nikolai Chernyshevsky, and later, Maxim Gorky, founder of Socialist Realism. Objective: To audit doctors’ knowledge of informed consent.Design: 10 consent scenarios with “true”, “false”, or “don’t know” answers were completed by doctors who care for children at a large district general hospital. These questions tested clinicians’ knowledge of who could give consent in different clinical situations.Setting: Royal United Hospital, Bath, UK.Results: 51 doctors participated . Paediatricians scored higher than other clinicians . Only 36% of paediatricians and 8% of other clinicians realised that the biological father of a child born before (...) 1 December 2003 needed a court order or a parental responsibility agreement to acquire parental responsibility, and thus be able to consent on behalf of his child, if he was not married to the child’s mother. Non-paediatric clinicians were unsure or incorrect when tested on situations where people with parental responsibility do not agree, or where young people , who are Fraser competent do not want to consult their parents. Most clinicians did not know that the parents of a 20-year-old man with severe learning difficulties are unable to consent to surgery on his behalf, and many non-paediatricians were unclear on who could give consent when a child lived with foster parents.Conclusion: Clinicians who obtain consent for the treatment of children need to increase their knowledge on who is able to give informed consent to ensure best practice. In his _Being Known_ Peacocke sets himself the task of answering how we come to know about metaphysical necessities. He proposes a semantic principle-based conception consisting of, first, his Principles of Possibility which pro­vide necessary and sufficient conditions for a new concept 'admissibility', and second, characterizations of possibility and of necessity in terms of that new con­cept. I focus on one structural feature; viz. the recursive application involved in the specification of 'admissibility'. After sketching Peacocke’s proposal, I intro­duce a fictional (...) protagonist, Cautious Peacocke, whose coherence I claim shows that Peacocke s proposal cannot be made good. I conclude with the conjecture that similar failure will attend any such semantic-based attempts to ground the epistemology of metaphysical necessity. -/- Dans son livre intitulé Being Known, C. Peacocke se propose de repondre à la question de savoir comment nous en venons a connaitre des nécessités métaphysiques. The notion of affordance remains elusive, notwithstanding its importance for the representation of agency, cognition, and behaviors. This paper lays down a foundation for an ontology of affordances by elaborating the idea of “core affordance” which would serve as a common ground for explaining existing diverse conceptions of affordances and their interrelationships. For this purpose, it analyzes M. T. Turvey’s dispositional theory of affordances in light of a formal ontology of dispositions. Consequently, two kinds of so-called “core affordances” are proposed: (...) specific and general ones. Inspired directly by Turvey’s original account, a specific core affordance is intimately connected to a specific agent, as it is reciprocal with a counterpart effectivity of this agent within the agent-environment system. On the opposite, a general core affordance does not depend on individual agents; rather, its realization involves an action by an instance of a determinate class of agents. The utility of such core affordances is illustrated by examining how they can be leveraged to formalize other major accounts of affordances. Additionally, it is briefly outlined how core affordances can be employed to analyze three notions that are closely allied with affordances: the environment, image schemas, and intentions. (shrink)

Edward Harold Fulcher Swain (1883?1970) developed a unique idea about the importance of forests, advocating the creation of a new society based upon forests, and he pursued policies to implement his unique vision of forestry when he served as the Director of Queensland's Forestry Board from 1918 to 1924 and the Forestry Commissioner for New South Wales from 1935 to 1948. Swain's beliefs developed out of a combination of his Australian experiences and connections with foresters in the British Empire and (...) America. When he could not convince Australian elites about the need to create a forest-based society, he asked foresters at the 1947 Empire Forestry Conference in London to assert the primacy of forestry in land management in the British Empire. Many foresters positively received parts of Swain's argument, but his ideas could never be fully implemented in the British Empire because of the dominance of agrarian doctrines of development in post-Second World War colonial planning and the rapid process of decolonization. Swain's life sheds light onto current debates among historians about the origin and legacy of forestry in Australia and the British Empire. His ideas, many that parallel the basic tenets of modern environmentalism, require historians to rethink the relationship between Empire forestry and environmentalism. (shrink)
